This letter is to clarify the situation regarding the RoHS directive, how it affects 3Com products and our customers.
3Com's public statement posted on www.3com.com is shown below:-
Restriction Of the use of certain Hazardous Substances (RoHS) Directive (2002/95/EC).
3Com are working with our Supply Chain and partners to ensure that as of 1st July 2006 all products sold within the EU & EFTA will comply with the requirements of the RoHS directive
- Unless specifically noted, 3Com will utilise the lead-in-solder exemption for network infrastructure equipment as permitted by item 7 of the Annex to the RoHS Directive (2002/95/EC).
- RoHS compliant units can be identified by the following logo on the packaging / unit label

Further clarification regarding “Put on the market”.
This is important as the RoHS directive applies to products "Put on the market" as of the 1st July 2006. This in turn means products that are "put on the market" before 1st July 2006 do not have to be "RoHS compliant".
Definition of "put on the market"- This means that a "Finished good" has been imported into the EU, has cleared all customs procedures, that legal title for the good has been transferred to 3Com and the good is freely available for sale. Any product that has been sold by 3Com to a third party within the EU/ EFTA before 1st July 2006 is "put on the market". This product can therefore be sold and/ or distributed freely within the EU/ EFTA at any point in time thereafter, regardless of whether or not it is RoHS compliant.
